Anwaltszulassung in USA/Kalifornien

Hallo liebe Kollegen,

man schielt ja immer wieder gerne über den Atlantik. Hat Jemand Ahnung, was man als Volljurist mit Anwaltszulassung zB in Kalifornien machen kann? Muss man studiert haben, um auftreten zu dürfen? Oder gibt es andere Möglichkeiten eine Zulassungen und/oder Anerkennung eines deutschen Jurastudiums in einem US-Bundesstaat zu erhalten?

Hallo Gandalf,

in meiner Studienzeit hab ich ein Praktikum bei einer deutschen Anwältin in CA absolviert.

Sie erzählte mir damals, dass sie nach dem 2. Staatsexamen, in CA noch ein Jahr zur Law School musste und erst nach bestandenem Bar Exam in CA als Anwältin zugelassen werden konnte.

To be admitted to practice law in California, an applicant must:

Complete the necessary pre-legal education;
File a registration application and be permitted to register as a law student or attorney applicant;
Complete the required legal education;
File an application, establish eligibility, take and pass the First-Year Law Students’ Examination, or establish exemption from the examination;
File an application, establish eligibility, take and pass the California Bar Examination;
File an application for moral character determination and receive a positive moral character determination from the Committee of Bar Examiners;
File an application, take the Multistate Professional Responsibility Examination, and achieve a scaled score of 79.00 or greater, which examination is administered and graded by the National Conference of Bar Examiners;
Comply with California court-ordered child or family support obligations.

There is no requirement of citizenship or residency, and there is no reciprocity with other states.

Ganz allgemein gilt jedenfalls, dass Du ohne bar exam in keinem der 50 Bundesstaaten als Anwalt (attorney at law) arbeiten kannst. Es gibt in einigen Bundesstaaten so etwas wie "Foreign Legal Consultant"-Status, dazu kann Dir RvH mehr erzählen, der die Rubrik Internationale Anwaltsfragen betreut.

Was nun allerdings wiederum die Voraussetzungen sind, um zum bar exam zugelassen zu werden, ist von Staat zu Staat unterschiedlich. Meist brauch man jedoch eine gewisse Mindestanzahl von amerikanischen law school credits, so beispielsweise in NY und CA. Das ist aber nicht überall so.

Für CA bedeutet dass entweder LLM oder zusätzlicher Unterricht an ABA Law School, Praxis in Heimat-Jurisdiktion, Nachweis gleichwertiger Ausbildung, Zulassung in anderer US Jurisdiktion
